Hereinafter the “Client”

These General Terms and Conditions aim to define the terms of distance selling between MOMENT(s) and the Customer, from ordering to payment and delivery. They regulate all the steps necessary for placing the order and ensure the monitoring of this order between the contracting parties.

By placing an order, the Customer acknowledges having read, understood and accepted the General Terms and Conditions. These General Terms and Conditions may be subject to change; the applicable conditions are those in effect on www.moments-vintage.com on the date the Internet User places the order.

The Client declares that he has the capacity to enter into this contract, that is to say, to be of legal age and not to be under guardianship or curatorship.

Products.

The products offered for sale by MOMENT(s) are those appearing on the site www.moments-selectionvintage.com, on the day the Customer consults the site.

Before putting a product online on the site, MOMENT(s) establishes for each one its “product sheet” and describes:

Its condition: New with tag / Very good condition / Good condition / Small defects
Its composition, if indicated on the original product
Its original size and its updated size. The size of the clothes varies according to the eras. Moment(s) according to a size grid available on the site evaluates the current size.
Its brand if it is indicated on the original product.
Its place of manufacture, if indicated on the original product

The products offered for sale are thus described and presented with the greatest possible accuracy, although certain characteristics have been reconstructed.

Available products offered on MOMENT(s) are considered to be in stock. Our product offers and prices are valid as long as they are visible on the site, within the limit of available stocks.

Price .

Prices are shown in euros (€) including all taxes and excluding delivery costs which remain the responsibility of the Customer unless otherwise stated or otherwise subject to special conditions.

The prices indicated take into account the VAT applicable on the day of the order. If the VAT rate were to be modified, it would be automatically reflected in the price of the items.
Moment(s) reserves the right to modify its prices at any time. Products will be invoiced on the basis of the rates in effect at the time the order is registered.

Order.

To be able to place an order, the Customer must first identify himself or register on the website www.moments-selectionvintage.com by completing the "Create my account" form.

Any order confirmed by the Customer constitutes express acceptance of the prices displayed and the descriptions of the products available for sale. In addition, the Customer declares having read these General Terms and Conditions before placing his order. Validation of the order constitutes acceptance of these General Terms and Conditions.

At each stage of the order, the Customer can check the contents of his order at any time and have access to all the information relating to the selected products, their price, the delivery conditions, the conditions and means of payment, and the right offered to him to withdraw from his order.

Validation of the order and its payment constitutes final confirmation of the order, which will be confirmed by sending an e-mail containing all the information already communicated, the General Terms and Conditions and the withdrawal form.

Payment .

Payment is made:

By credit card
By Paypal
By e-gift card

The invoice can also be downloaded in the “my orders” section accessible in your “My Account” area.

Online payment by credit card:

The cards accepted are Carte Bleue, Visa, Mastercard and American Express.

The account is debited 5 to 6 days after the bank transaction is recorded.

In the event of a stock shortage, the amount of the cancelled item(s) will either be deducted from the total amount debited or credited back to the Customer's account within 3 working days after the amount including the cancelled item(s) has been debited.

Online payment by Paypal:

In the case of payment of the order by Paypal, the Customer with a PayPal account enters his email address linked to his PayPal account and his PayPal password. PayPal encrypts all the information that the Customer communicated to it when creating his account.

Therefore, no information other than the Customer's email address is communicated to Promod.

Financial and personal information is automatically encrypted when sending any sensitive information to PAYPAL servers. For more information on the security of transactions between PAYPAL and the Customer's banking institution, Promod invites the latter to contact PAYPAL.

In the event of an item return, the refund will be made in the form of a credit to the Paypal account used to pay for the original order.

Payment by e-gift card:

It is possible to pay for all or part of the order using a Moment(s) e-gift card.

In the case of partial payment of the order, it is possible to pay the balance by credit card (see above for these payment methods). In the event of payment of the balance by credit card, the order will be automatically validated and shipped.

Delivery.

Except in cases of force majeure or unforeseeable and insurmountable act of a third party to the contract, delivery times will be those indicated below.

Shipping costs vary depending on the carrier chosen and its destination.

Orders are shipped from France (94) by carriers with which MOMENT(s) collaborates within the timeframes indicated above. Taking into account that these times are counted from the moment the order is closed, prepared, leaves the MOMENT(s) warehouse and is handed over to the carrier.

Please note that all deliveries are free in France for all orders over €150 including tax.

Receipt of delivery.

Moment(s) takes all precautions to ensure that the products arrive in perfect condition. The Customer is required to check the condition of the packaging and the conformity of the delivered product, and to issue any reservations on the carrier's delivery note, if necessary.

Right of withdrawal.

The Buyer may, if they wish, make a return request within 14 calendar days of receipt of the order to make the return request on the interface provided for this purpose, providing an email address and the order number.

Once this period has expired, the customer no longer has this right of withdrawal. When this period expires on a weekend, public holiday or non-working day, it is extended until the next working day.

MOMENT(s) will reimburse the Customer within a maximum of 14 days on the payment method used, from the date on which MOMENT(s) became aware of his wish to withdraw.

However, MOMENT(s) reserves the right to defer reimbursement until receipt of the items concerned by the withdrawal. The Customer undertakes not to do anything that could depreciate the products ordered resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of these products.

The return costs remain the responsibility of the Customer.

Intellectual property.

All elements of the MOMENT(s) site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents.

They are the exclusive property of the company MOMENT(s). The user who has a personal website and who wishes to place, for personal use, on his site a simple link directly referring to the homepage of the MOMENT(s) site, must request authorization from the company MOMENT(s). In this case, it will not be an implicit affiliation agreement.

On the other hand, any hyperlink to the MOMENT(s) site using the technique of framing, deep-linking, in-line linking or any other deep link technique is in any event formally prohibited.
In any case, any link, even tacitly authorized, must be removed upon simple request from the company MOMENT(s).

Responsibility.

MOMENT(s) cannot be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a breakdown in service, an external intrusion or the presence of computer viruses, or any event qualified as force majeure, in accordance with case law.

Furthermore, MOMENT(s) disclaims any liability for any failure to meet its contractual obligations in the event of force majeure or an unforeseeable and insurmountable act of a third party to the contract, or in the event of a fault attributable to the Customer preventing MOMENT(s) from fulfilling its obligations in the context of distance selling.
